The US Postal Service (USPS) has released the final PACT Act rules pertaining to the non-mailability of Electronic Nicotine Delivery Systems (ENDS).

BOOM Headshop is pleased that the final rules do not prohibit the mailing of devices that are only compatible with solid concentrates and/or dry herb material. The rules do, however, prohibit using USPS to send devices that are capable of use with liquids and oils (e.g., 510 batteries and pre-filled vaporizers). Oil and liquid devices may still be sent via private carriers, subject to significant compliance obligations.

The continued ability to mail such devices is a critical win for the industry.  The vast majority of BOOM Headshop’s Consumer Goods products are used with solid concentrates and/or dry herb material. Therefore, the impact to BOOM Headshop’s operations, and to our customers, is minimal. The ruling does not impact ENDS sales for Industrial Goods, which are delivered to businesses via freight.

BOOM Headshop is compliant with the PACT Act and our associates have in-depth regulatory knowledge and experience in this area.
